The ninth circuit court has upheld a ban on sending national guard in the Oregon city, following a recent court ruling.

Appeals Court Concurs to Rehear Case

The federal appeals court decided on Tuesday that it would rehear the legal dispute concerning the president’s authority with an larger panel of eleven justices. The court also overturned a earlier ruling from a smaller judicial group that had supported the federal government.

Legal Saga Over Troop Deployment

This order represents the latest development in a long-running legal battle over whether the former president has the legal right and valid reason to deploy state military units in the city. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was started in response to months of protests.

Differing Viewpoints

The administration has claimed that federal officials at the ICE facility in the southern part of the city were under attack, while city and state officials assert that municipal police have command of the situation.

Court Proceedings

The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any national guard troops in Oregon, after attempts to circumvent the first order by mobilizing troops from California.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing command of 200 Oregon national guard – but the subsequent injunction remained in place, blocking the physical sending of the troops.

The latest ruling means the issue will be heard by the full court – with both rulings under consideration simultaneously – by a group of 11 judges.

“This ruling demonstrates that the truth matters and that the judicial system are striving to hold this administration accountable. The founding document limits the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.
